Privacy Policy
This privacy policy applies to the EyeSpeak app (hereby referred to as "Application") for mobile devices that was created by EyeSpeak (hereby referred to as "Service Provider") as a Free service. This service is intended for use "AS IS".
What information does the Application obtain and how is it used?
Face Data Collection (TrueDepth API)
The Application uses the device's TrueDepth API and front-facing camera to capture face data in real-time to enable assistive communication for users with paralysis or severe motor disabilities.
What face data does the Application collect?
EyeSpeak uses Apple's TrueDepth API and the device's front-facing camera to detect and track:
- Eye movements (looking up, down, left, right)
- Eye blinks and winks (left eye, right eye)
- Facial gestures (such as lip movements)
- Head position and orientation
This data is processed in real-time to enable communication through eye and facial movements.
How is this face data used?
Face data collected through the TrueDepth API is used exclusively for the following purposes:
- Detecting user eye movements and facial gestures to enable communication
- Calibrating the app to each user's unique abilities and movement patterns
- Activating switch scanning interface when specific movements are detected
- Selecting buttons and typing messages based on detected movements
Important: Face data is processed locally on your device in real-time and is never stored, saved, or retained by the Application. The data exists only temporarily in device memory during active use and is immediately discarded after processing.
Is face data shared with third parties?
No. Face data is never transmitted, shared, sold, or disclosed to any third parties. All processing happens locally on your device. The Application does not send face data to external servers, analytics services, or any other third parties.
Where is face data stored?
Face data is not stored. It is processed in real-time on your device and immediately discarded. No face data is:
- Saved to device storage
- Uploaded to external servers
- Retained in any form after use
- Accessible to the Service Provider or any third parties
Data Retention
Face data is not retained. Processing occurs momentarily during app use and the data is immediately deleted from memory once processed. There is no persistent storage of face data.
User-Created Content
Users may create custom communication buttons, phrases, and keyboard layouts within the Application. This content is stored locally on your device and is never transmitted to the Service Provider or any third parties. Users maintain full control over this content and can delete it at any time by uninstalling the Application or clearing app data.
No Other Data Collection
The Application does not collect, store, or transmit:
- Personal identification information (name, email, phone number, etc.)
- Contact information
- Location data
- Device identifiers
- Usage analytics or statistics
- Any other personal data
Registration is not required to use the Application.
Does the Application collect precise real-time location information of the device?
No. This Application does not collect any information about the location of your mobile device.
Do third parties see and/or have access to information obtained by the Application?
No. The Application does not share any data with third parties. Face data is processed locally on your device and is never transmitted externally. User-created content remains on your device only.
What are my opt-out rights?
You can stop all use of the Application and deletion of locally stored user-created content by uninstalling the Application. You may use the standard uninstall processes available on your mobile device or via the mobile application marketplace.
Since face data is not stored or retained, there is no face data to delete. All face data processing stops immediately when you close the Application.
Camera Permission
The Application requires camera access to function. When you first launch the Application, you will be asked to grant camera permission. This permission is necessary for the Application to use the TrueDepth API to detect your eye movements and facial gestures.
You can revoke camera permission at any time through your device settings. However, the Application will not function without camera access, as it is essential for assistive communication features.
The camera is used exclusively for real-time face data processing as described in this policy. No photos or videos are captured, recorded, or stored.
Children
The Application is not used to knowingly solicit data from or market to children under the age of 13.
The Service Provider does not knowingly collect personally identifiable information from children. The Service Provider encourages all children to never submit any personally identifiable information through the Application and/or Services. The Service Provider encourages parents and legal guardians to monitor their children's Internet usage and to help enforce this Policy by instructing their children never to provide personally identifiable information through the Application and/or Services without their permission.
If you have reason to believe that a child has provided personally identifiable information to the Service Provider through the Application and/or Services, please contact the Service Provider at support@eyespeakapp.com so that they will be able to take the necessary actions. You must also be at least 16 years of age to consent to the processing of your personally identifiable information in your country (in some countries we may allow your parent or guardian to do so on your behalf).
Security
The Service Provider is concerned about safeguarding the confidentiality of your information. Since face data is processed locally on your device and is never stored or transmitted, and the Application does not collect any other personal information, the risk of unauthorized access to your data is minimized.
The Application implements the following security measures:
- All face data processing occurs locally on your device
- No face data is transmitted over the internet
- No personal data is collected or stored
- User-created content remains on your device only
However, please be aware that no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your privacy, we cannot guarantee absolute security.
International Users
The Application is designed to comply with international privacy regulations, including:
- General Data Protection Regulation (GDPR) - European Union
- California Consumer Privacy Act (CCPA) - United States
- Personal Data Protection Act - Indonesia
Since the Application does not collect, store, or transmit personal data or face data, there is no data processing that would require cross-border data transfers or additional compliance measures.
Changes to This Privacy Policy
This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any changes to their Privacy Policy by updating this page with the new Privacy Policy and updating the "Last updated" date at the top of this policy.
You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes. Material changes will be highlighted in the Application when they occur.
Your Consent
By using the Application, you are consenting to the processing of face data as set forth in this Privacy Policy. You understand that:
- Face data is processed locally on your device using the TrueDepth API
- Face data is never stored, saved, or transmitted externally
- Face data is used solely for assistive communication purposes
- You can stop all face data processing by closing or uninstalling the Application
